Courts Say Christian Church Not Allowed to Practice Christianity

Should a Christian church be allowed to practice its faith in all of its activities?

Not according to a New Jersey judge.

In 2007, a lesbian couple, Harriet Bernstein and Luisa Paster asked Ocean Grove Camp Meeting Association for permission to hold their civil union at the picturesque seaside facility. Ocean Grove, who is associated with the United Methodist Church, declined the request because of their belief in what the Bible says against homosexuality.

Their facility is located on the Atlantic coast and has an open air pavilion where they held various functions and activities, many of which are done as a religious outreach.

The couple filed a discrimination complaint against Ocean Grove. The New Jersey Division of Civil Rights joined in on the complaint filed by the lesbian couple.
Jim Campbell, a litigation staff counsel for the Alliance Defense Fund, argued on behalf of Ocean Grove,

“The government should not be able to force a private Christian organization to use its property in a way that would violate its own religious beliefs. Religious groups have the right to use their private property in a way that is consistent with their beliefs. That right, protected by both the New Jersey and U.S. constitutions, obviously trumps any law enacted by the state’s legislature.

“Through these events, the association connects with people who might not attend its worship services and encourages them to attend those services in the future. For example, the association begins its Saturday-night family entertainment events with a brief prayer and typically a quick promotion of its upcoming religious services and events. These are just some of the diverse ways that the association strives, in all its programs, to reach the entire community with the love and Gospel message of Jesus Christ.”

Administrative law judge Solomon Metzger disagreed with Alliance Defense Fund and ruled that Ocean Grove in fact had violated the civil rights of the lesbian couple. In his decision, he wrote,

“The respondent violated the [Law Against Discrimination] when it refused to conduct a civil-union ceremony for Ms. Bernstein and Ms. Paster. Respondent opposes same-sex unions as a matter of religious belief, and in 2007 found itself on the wrong side of recent changes in the law…

“As a religious organization that deems same-gender unions sinful, respondent is loath to be associated with such ceremonies and maintains that compelling this through the LAD violates its right of expressive association, free speech and free exercise of religion.

“That it had never before declined a wedding, other than for scheduling conflicts, only means that it had never before been asked to permit a same-gender service.”

Not only did Metzger rule against Ocean Grove, but the association also lost part of the tax exempt status for that part of the property where the open air pavilion is located. Fortunately, they were able to re-file for tax exempt status for the section of land under a different application and it was granted.

Time and again we are seeing how the judicial system is denying the constitutional rights of Christians and giving favored rights to minority groups like homosexuals and Muslims as in the case of the Oklahoma state constitutional amendment being blocked because of one Muslim leader.

Unless we get real Christians in positions of leadership in our nation and they appoint judges who will rule on the constitution and not their own personal agendas, it won’t be long before Christians have no rights and we’ll be the outlawed religion here in what once was a Christian nation.

    I hope the lesbians have the courtesy to invite the judge to their desecration of a church. If I were the church, I would still refuse. Force the issue to the Supreme Court and refuse to hold the ceremony until their final ruling. if they have to, fellow Christians in NJ and the surrounding area should help them out by booking the pavilion every day for the next ten years with other events. "Sorry sister, we're booked till 2022. But we WILL pray for your souls at service."

    They want to remove tax-exempt status? Fine. Call for donations to cover those costs. People are fed up with having their faith and God mocked by these heathens and whores. We don't have to accept this decision. We can fight back.

        They need to stand for GOD even if they have to do it in jail. I have always heard people called "Trash" This is the first time I ever agreed that people can rightly be called trash, except I have never seen any trash this, "unclean" or "dirty" or "ungodly."

        We, as Christians need to get ready to spend time in jail because it is coming. Live according to Satan's teachings or spend time in jail or be able to hideout somewhere. Any real Christian will fight this evil disease!!!

Hey, I'm sure these two can find a Druid group somewhere in the country who will perform whatever it is that they perform and they can become wife and wife, or les be friends, whatever.       The Supreme Court has confirmed a Church has the right to govern itself according to their religious interpretation; therefore, they can reject this application and will have support of the Court!!!

As a matter of fact, Pastor Chuck Baldwin, until recently of Pensacola, Fl, now of Montana, has refused tax exempt status claiming that it makes the church beholden to the state through the IRS. If a church claims tax exempt status it is not allowed to make any political statements or endorsements whatsoever. All churches should reject tax exempt status, if they did, it would begin the rise of the Black Robe Regiment again. Church leaders used to wear the long black robes of the clergy, with King George III calling them a fifth regiment against him in the American Revolution.

      I don't think there should be a problem. No Bible believing Church Pastor would join the two women in matrimony. We are not called to condem the world but, to call sinners to repentance. I don't agree with the ruling but, unless and untill it is appealed, the Property must be provided as consistant with the law. The two women can get a Justice of the Peace (or whatever) to officiate their "ceremony." Upon the property (If that is actually what they wanted and still wish to do). The church can at that same time hold a prayer vigil, and speak their mind with banners declaring the scriptures that condemn the sin they wish to practice on property not in conflict with the "rental" property to be used.

      God judges those without. Our job is to show God's mercy and love is greater than His wrath, in calling sinners to repentance; (even as we remember that we also once also walked in like darkness.)

      Good response. We need to disregard rulings like this that are obviously unconstitutional. The church needs to tell the court to butt out and the lesbians need to be asked to find another place for their foolishness. Christians do not have to tolerate bullies and they need to start defending themselves from these silly attacks.

          In this case the "law of the land" in NJ is being argued to be in conflict with the Constitution (which is the ultimate law of the land). The church should appeal this as high as is necessary. How is the church being a bully? Did they search out these women and taunt them?

I would never, ever allow this kind of desecration in a church or on any church grounds. I'm not sure I would pray for their souls, but I would pray for their salvation.
      Tax exempt? I am sure all churches will soon lose their tax exempt status under obambam. That is, unless they are muslims. The time has come to take a strong stand and if the court goes against the constitution, then the supreme court has to go. They are there to uphold the constitution and nothing more. Get their personal agendas out of the courts.

      I'm with you Michael, but I sometimes wonder if churches are giving in to such pressures for fear of losing their tax exempt status. I personally believe the church should have the same exemptions/deductions as any other person or business, but that's it. They have allowed themselves to be a peculiar position under the government and should break those ties now.

      I think to show support of the church, people should disrupt the ceremony in a peaceful protest, not like the other "baptist" church that protested funeral services of fallen soldiers. Carry signs and make noise, maybe shout out some invectives to make a point. See how they like that!!!!!

      Which would accomplish nothing. (They might be charged with arson.) We must exercise, not civil disobedience, but Constitutional disobedience. When a judge clearly and willingly violates the Constitution by some asinine ruling, we should simply ignore it. This country has too many sheeple and not nearly enough patriots. I hope and pray this congregation gets a backbone and tells the judge to stick it! Other Christians in this community should also take a stand with them.         Yup. The only way to stop socialism is to speak out and stand up. If I was the church pastor, I would say "the judge has made his ruling, now let's see him enforce it." I would also lock up the place on the day those people want to have their ceremony and bring out the entire congregation to physically block the entrance.       These two women I guess chose the pavilion because it is an attractive setting near the ocean, but it appears that the large building in the background has a huge cross on it and these two lesbians are nominally Jewish. It seems that they may have chosen it simply to pursue a suit to prove "we can do what we want when we want where we want". So what if it tramples on the rights of others. There was a similar suit against an inn in New England and another against a bakery that denied service to same-sex couples.
      I agree with EDinNola that the judge is in the wrong and should be impeached or voted out of office!
      My great -grandfather was one of the founding ministers of the Ocean Grove Camp Meeting. He must be turning in his grave.

      I wonder what would happen if this was instead of a Christian church it was a Mosque and because they have a beautiful setting denied access to it for a Christian couple or gay couple wanted to be married? You can bet the Muslims would have no part of it. You can't pick and choose which rules apply to certain churches. They are all to abide with the same laws. I'm sure there is some where a beautiful setting this gay/lesbian couple can have a ceremony for a legal union with out this ending up in the Supreme court.

      What was it...about three years maybe four ago...that homos began going to this church in California...and they soon outnumbered the regular members...then they filed a suit to claim the properties of that church...and won the case in a secular court? And three years ago, in Oklahoma, Tulsa county, a woman filed suit against a Church of Christ because they would not allow her to TEACH, ( 1 Tim 2:12, "But I suffer not a woman to teach, nor to usurp authority over the man, but to be in silence." ) and also because of her abusive attitudes, they were disfellowshipping her...The secular courts ruled in her favor, awarding a MONETARY decision! I forget how much she was awarded, but THAT...opens the door to all kinds of discrimination against religious bodies by the so-called courts (judges...of whom many are homos themselves) Look at some of the supreme court judges, and a number of high officials in our government.

      This judge may well hate Christians but he is not indicative of all Jews. (Some) Christian religions consider their religion is 'Judeo-Christian'
      The judge is an anti-Christian bigot (probably an atheist, or agnostic - he obviously does not know God's word. I doubt seriously his ruling will stand because it's 100% wrong (doesn't know his Constitution) and this was not a case in which a tax exempt status comes into play -look up Johnson's Gag Order (aroung 1952-54).......evidently all the judge knows is how to put on his robe.

      What people must understand about American Jews is that most are not that dissimilar to the various "types" of Christians in that may are atheists while others are agnostics, liberal, and few are conservative sincere practitioners of Judism.           The West Bank and Gaza are governed by the Palestinian Authority, so cannot be compared to the internal policies of apartheid South Africa, and that restrictions are only imposed on those territories by Israel for reasons of security.

          Israel cannot accurately be called an apartheid state because Israeli law guarantees Arab citizens of Israel the same rights as other Israeli citizens without distinction of race, creed or sex.

          They also note that Israel's Arab citizens can and do run in elections and become ministers in the Israeli government.

          Uhm, I don't know what history you've read, but the Jewish people's "Bible" is the Torah; this book is the the same as the first five books of the Old Testament (Genesis, Exodus, Leviticus, Numbers, Deuteronomy - just in case you weren't sure). The Talmud is an oral tradition that was written down by rabbis in about 200 CE that explains how to understand and interpret the laws in the Torah. If you had even looked up those two words (Torah and Talmud), you would have found this same information as easily as I did. Next time do a little research before you open up your mouth and remove all doubt about your ignorance. Thanks.

      Not only is homosexuality an abomanition by God, it is an abomanition against the natural order! No matter how many times homosexuals say, it will never be natural for the same sexes of a species to go through life as a coupled pair! Centuries ago the Church forced the teaching that the Earth was the center of the universe and it was flat; to the point of killing those who thought different (before the religious folks go off on what I wrote, I do not bring this up to mock anyones religion, but it is the truth, a horrible one, that we see happening again with Islam).       My thought when I read this article was exactly the same. WHY is no one trying these "stunts" at the mosques?
      I think there are enough american patriots left that would do the same thing in a muslum church and then MAKE the judicial system rule the same for both. If a christian church has to give in to homo's, so would every other, including islam. At that point, islam would be legally forced to recognize homo's as well as conduct "marriages" for them. Even if the people do not want "married", do it just to press the point home to the judges that "what is good for one is good for the other" and "we are ALL "Equal", no more tip toeing around other religions. If one church "haas to" do something, they ALL, including muslum, islam and sharia law would NOT be exempt, but HAVE TO keep the same judgements made as a christian church. After all, do we not ALL want to be treated "FAIR" and "EQUAL"? Which at this time would mean this ruling would ALSO effect any- ANY mosque and ANY pair of homo's wanting" married" would have to- HAVE TO be performed at the mosque or face the same type of legal action as the christian church.

Get it in to a Federal Court you stand a much better chance. These other judges are needed to be removed in that they do not follow law.

      "Administrative Law" is a strange breed of cat largely unknown at the time of the ratification of the Constitution and Bill of Rights.
      The administrative agencies tend to blur prosecutorial and adjudicative functions. Their rulings are normallyu upheld on appel if there is any "substantial evidence" such that any rational trier of fact could agree with their findings and conclusions, whetehr the reviewing court does or not. Often unfortunately, we're stuck with the administrative law system and the Supreme Court will not invalidate it.

      The article does not include the arguments, nor the Administrative Law Judge's findings and conclusions, making it hard ot see exactly how this cse went down. We are not told, for example, if the pavilion or other related property have been rented out to non-Christian or secular groups for secular purposes, etc.

      This is one of the traps you get into when you make homosexual conduct a civil right and redefine marriage to include same-sex "couples."

It was amazing to me that Michele Bachman had to teach a class on the US Constitution to the incoming Congressmen in 2010.     This declaration of civil rights, while allowable by civil law, is between the couple and the State. While it may be entirely legal in a court of Man's Law, this union should be held on State-owned property..not forced upon a church to change their Christian beliefs, to accomodate all. The Constitution provides for Freedom of Religion, which means one belief shall not be forced upon another one. The act of forcing this ceremony to be performed on land owned by a particular religious group (in this case, the Methodist Church) would be akin to the Methodist Church forcing their belief on everyone else...much like the Church of England was forced on British citizens, which led to the founding of the United States of America, where religious freedom is Constitutionally guaranteed..but not imposed on everyone to be of the same belief. Each person has freedom of religion and speech...but the person/group being spoken to or approached to alter their own belief also has the right of rebuttal and refusal.

    It never ceases to amaze me how ignorant the Churches of America are, as well as its people, and is reflected by the author of this article.Its a fact we fought and won a great revolutionary war to forever gain our choice to worship as we please without any government interference.So, how can our courts rule this way? What in the world gives them the athority to do so?
    The answer is simple- we did. When a church applies for and accepts the 501c3 status of tax exemption, it agrees to all rules and regulations of the government and its code. Essentially, giving up the freedom which it had,only to be governed once again.
    A clever scheme, and the people and the churches fell for it, thinking they are getting some benefit when they already had the freedom to do so. Our ancestors never dreamed its people would become so ignorant. And most Americans will dismiss this, as there is no way this could be so, without even reasearching or making any attempt to find out the facts.     This is crap, and that judge is rediculously wrong. The couple may have a newly granted right to get married in New Jersey, but that doesn't mean they have a right to hold their wedding ceremony anywhere they choose. No person's (or group's) civil rights can trample upon the civil rights of another person (or group). In this case, the judge trampled upon the civil rights of the church to use their own private property only for their own approved purposes, in addition to trampling upon the church's freedom of religion. I wonder how he would have ruled if the private property this couple had chosen for their wedding ceremony wasn't the property of a church. What if it was just some rich guy's private beach property. Would the gay couple still have the "right" to hold their wedding there? I seriously doubt it. And by the way, this has nothing to do with gay rights. It's got to do with private property rights and a liberal judge promoting his liberal agenda.

      501c3 should have no place in your decision of where to worship. It is a total scam used only for intimidation. Most churches go along with it because they think the congregation believes in it and most do. The pitiful part is, many pastors will water down their message thinking the IRS means what it says in 501c3 when, in fact, it has NEVER been enforced or even attempted to be enforced because the IRS knows it would be declared unconstitutional. So they only use it to intimidate.

    Frankly whether they are Christians is not important. In the US, under our Constitution, property owners are free to allow or prohibit any otherwise legal activity. This is a fundamental right. When the government can compel you to allow someone to do something on or with your property, it is a violation of the first amendment's guarantee to freedom of association.

    The Supreme Court unanimously found that such government control over who churches can hire would violate the religion clauses of the First Amendment. I would think this would also apply to the subject matter at hand in your article. A church has the right not to participate in a union they feel violated their basic beliefs.

    How I was going to comment...Michael...you already did. Get rid of the tax exempt status. That is a way and a perk that the government uses to control what a Christian organization does. If you aren't "tax exempt", you can exercise ALL the rights of the constitution and the governments HAVE no say!

They are trying to do what the legislature is not Constitutionally allowed to do--make law regarding the freedom of religious exercise (and a lot of other things!). They are violating their oath of office to 'uphold, protect and defend' the Constitution of this great country. They are using their office and position to try to invalidate the First Amendment by ignoring the "separation of powers" clause of the U.S. Constitution. They should be removed from the bench and forbidden to ever hold any public office again. We need judges we can respect and trust.

    As I was watching the news the other night and reading on the internet all that is going on in our country – appointments being made outside the Constitution, numerous rulings by the courts, requests being made to raise the debt ceiling again – I nearly felt a feeling of helplessness and frustration try to come upon me. It was like “if our elected officials will not do anything to stop this, what are we supposed to do about it or is there even anything we can do?” The elections seem so far away and what damage might be done until then!

    Then this feeling arose inside of me that said “You know what, Enough is Enough! It is time for God's Warriors, His Church, the Body of Christ to shake off their slumber and take a stand! Stand together as a unified body, with one voice”. And I mean that literally.

    We need to have our own grassroots National Day of Prayer. This is what I would like to propose: On Thursday, January 19, 2012 at 1:00 pm Central Standard time, I would like each one of us to come before the Lord, at the exact same time, in unity. First (with a resounding voice) to praise and bless His Name, proclaim His Awesomeness, to honor His Faithfulness, to thank Him for His Grace, His Mercy and for all He has done for each one of us, our families and for our Nation. And then, standing in agreement and unified, cry out to God – ask for His Divine intervention on behalf of our Nation and each of her citizens and for protection against anything that might cause lasting damage to our Nation!

    “Again I tell you, if two of you on earth agree about whatever they may ask, it will come to pass and be done for them by My Father in Heaven” (Matthew 18:19). “For with God nothing is ever impossible and no word from God shall be without power or impossible of fulfillment” (Luke 1:37). No matter how difficult or impossible the situation may seem, God can always bring change and restoration!

    It is time for this “sleeping giant” (the Church) to arise. If you will stand in agreement with me on January 19th (1:00 pm. CST), please copy and re-post this everywhere you can. E-mail it to friends. Lets get people all across our Nation, at one specific time, who will stand together in Spiritual unity and pray with a mighty voice!!

    Then we will watch as the miraculous takes place!!!

    I would push to have this Judge disbarred for on simple reason .... there were OTHER facilities available nearby the could and would perform the ceremony because in NEW JERSEY ... as long as other facilities can render the services and the services are NOT life-threatening or endangering the person seeking services ANY facility has the right to REFUSE services. Already been as least ONE case tried against Mordecai Boat Basin in the 1980s by the State of New Jersey .. and that was the decision. So YEAH, there is a precedent ... and the JUDGE WAS WRONG ...

The only way I see to rectify the situation is to make all judge ships ELECTED positions of fixed terms, including the supreme court justices. In that manner, if we somehow get a loser like we currently have in the white house, who appoints far left judges, they can be voted out if they are not upholding the laws and issuing their rulings in accordance with the constitution.

    Ocean Grove UMC either should seek a rehaering, or should appeal, on the authority of Perich v, Hosanna-Tabor Evangelical Lutheran Church, a U.S. Supreme Court case, hadded down a few days ago, that UNANIMOUSLY held that the free exercise clause of the U.S. Constitution trumped the anti-discrimination provisions of the Federal ADA (and, presumptively, state anti-discrimination statutes and constitutional provisions). In Perich, a church related school fired a "called teacher" for pursuing an EEOC claim, that was not even based upon theological issues, but had its genisis in a physical disability that caused the teacher to take a recuperative leave-of-absence, during which she was replaced, It sounds as if the OAK Grove UMC case is on all-fours with Perich!!!.

    A Supreme Court case, if there was ever one! The Supreme Court just ruled in favor of a church who was being told by the Justice Department that they could not fire a minister that they had fired for church-related reasons. I suspect this will be appealed, and will probably be settled in the church's favor by the time it reaches the Supreme Court.

    The church should have asked for a trial with a jury of its peers to decide. Then the judge would have had to read the results of the jury and pass sentence only, not pass judgement himself. The jury would have put an end to the claims once and for all with a not guilty verdict.

Yes, christians do need to stand up and defend their faith and beliefs, God certainly will not be mocked by those who are against Him. Now, I need to stop and ask, ' what would Jesus do?' In many places God's word is very clear regarding sodomy, it even says that men will lay with men and women will lay with women, God is giving them over to their fleshly desires. However, God calls us to love the person but not the lifestyle....we are to pray for them, bring them to the throneroom of the Almighty God who is Creator of all things.     Interesting ,I am not a lawyer but it would seem to me that in this ruling , the judge just violated the Civil Rights of the Ocean Grove Meeting . Were I them , I believe I would be instructing my attorneys to appeal all the way up the judicial system . Bonnie Wheelers comments above sum things up in full. And in this ruling the judge in effect that a total stranger, or a person known to us and whom we would not wish to associate with , and who desires our friendship, must be given that friendship or we violate their civil rights .
    It is obvious that these two individuals have no respect for anyone or anything other than their own selfish desire to have things their way . As to their lesbian relation it wis Adam and Eve not , Annie and Eve . And if that is Politically incorrect , tough !

    Not enough facts...need to find out how this case wound up in an Administrative Court for - we are not told - a hearing or for final adjudication? No doubt, though, the Administrative Court was chosen because it was less expensive, less time-consuming, the rules of civil procedure are not as intricate as for a civil court of law, therefore, the rules of evidence are different - the matter is decided only by a Judge and most importantly, when this type of venue is chosen, the result is final and cannot be appealed. Most likely, this "couple" had their attorney do some judge-shopping. There is an interesting side to this - compare this case to the recent U.S. Supreme Court 9-0 decision (in Michigan) re: the case of the woman in the Episcopal Church who was fired for not adhering to Church doctrine - too bad this case didn't come in under that ruling...Ocean Grove might have won on the same grounds - the First Amendment does not belong to individuals, it exists as a lawful restraint on government interference on religious freedom, and the State of New Jersey had no business interfering with a private religious matter...

    There are many good and valid reasons to vote against same sex marriage - natural order, religion, public morality, philosophy, law and behavior theory, child development, preserving American tradition, preventing the collapse of western civilization, parental instincts, protecting the true meaning of marriage, among others.

    Over the years, a well-organized group of atheists with political beliefs similar to the Bolsheviks has come to dominate all of the sensitive positions in government and education. Anyone not agreeing with them is to be denied employment in these fields. They are remaking the country to their own wishes, and the Americans have been standing around like sheep letting it all happen. The most obvious crime by this group is the mass murder of veterans, who are literally starved to death in the streets through denial of all but the most menial employment at a near minimum wage. Veterans are denied jobs in education, the civil service, science and research, and any other field which might give them a leadership role. Although some veterans have succeeded in surviving, several hundred thousand have died decades before their time through actions by the government they served. That is their punishment for defending the country against Communism during the hot phases of the Cold War. Our Constitution says that both religion and the practice thereof are not to be interfered with, but the Communists controlling our courts and education system say that religion is still allowed at their pleasure but the practice thereof is to be prohibited. You are free to call yourself a Catholic, Protestant, or Jew, but watch out if you speak about your faith or the morals it teaches.

If this is the case and this is the judge's ruling, then by the same token, Christian churches should be legally allowed to hold prayer meetings in the middle of Gay rights rallies, functions held by the Rainbow Coolition and coencide some church functions with gay/lesbian weddings. Observance of personal rights and liberties are a two way street and the gay movement can now thank this judge and these two lesbians' litigation for opening the door for Church and church members' rights observances being lawfully protected when faced by gay/lesbian activity conflicts with Christian activities. Thank you judge and lizzies. What's good for the church is good for the lesbians if reversed. Now all we have to do is apply this lesson in reverse and prominently promote this judge's name, his court and the names of these lesbians as the source for the lawful practice. They have now made history.

    This nation has never been a theocracy as many have opined, nowhere in the Bill of Rights, or Constitution is Our Nation decreed to be a "Christian Nation", that is a label imposed by the Christians. The concept of separation of church and state was to avoid the oppression of the Church of England in this new country. We are a secular society with many people of diverse beliefs. The rights of these people to enter into a civil union is provided for in the Constitution, as freedom of choice and expression. The Christian Religion has from the beginning attempted to exert it's influence on government, and impose their beliefs on others through various means of lobbying, and economic coercion through boycotts etc. If a religious organization is conducting a business open to the public, then laws against discrimination of any form should apply to them as it does in any business. If they find the concept of same gender unions offensive, then their business should be private, members only. They can not expect to have tax free status, operate a public business, and be allowed to discriminate on the basis of gender preference.

       Craig- Like most liberals, you are distorting what the Constitution says. The 1st Amendment does not say freedom of expression. It says freedom of speech, which refers to voicing your opinion or criticizing the government without being prosecuted. It does not refer to entering into "civil unions" or having the government pay for "art". Try actually reading the Constitution as well as the Federalist Papers, Anti-Federalist Papers, and accurate history not from school textbooks.
      Liberals are the ones who are imposing their beliefs on everyone through the coercion of political correctness and "not offending anyone". The 1st Amendment also does not say "separation of church and state". That came from a letter that Thomas Jefferson wrote in 1802 and was referring to the "wall of separation" between state and federal authority. Read the 10th Amendment!

      While I agree that our nation's greatest strength is a failure to impose one religion on all of us, the First Amendment to our Constitution guarantees that the New Jersey Division of Civil Rights may not compel (or join in compelling) a Christian group to celebrate a marriage that is contrary to their beliefs. The tax exemption afforded churches is not based on provision of marriage services to all comers, any more than PETA's tax exemption depends on them allowing people to wear fur coats to their functions or on their property. It is a recognition that the organization does not make a profit on its activities, is not specifically political in its activities and thus is exempt from taxes by our customs. Had the Supreme Court been allowed to judge on this case, I'm confident Judge Metzger's ruling would have been overturned. Compelling the congregation at Ocean Grove to celebrate marriages in violation of their mores is discrimination of a type forbidden by the First Amendment to the Constitution. Their tax-free status doesn't depend on their behaving contrary to their faith any more than the tax-free status of a synagogue or a mosque depends on their opening of their premises to a pork barbecue fundraiser.

    Evidently this judge did not have any concept of the Supremacy of the US Constitution. Amendment #1 clearly states that the government has not right to infringe on the free exercise of religion. Not participating in a function which it is convicted that the function is sinful, is exercising their religion. The fact that they had not refused a wedding ceremony before is irrelevant. Those ceremonies were between a man and a woman and therefore not contrary to the teachings of the Bible, upon which this organization bases its religious beliefs and practices.

    This should be appealed through the court systems and, provided the judiciary is not stacked with activist judges, would be overturned by a higher court. There is no precedence not standing for this judges decision. It is clear, by the judge's own statements, that he placed local state law above that of the US Constitution.

    How is it that this decision is even alllowed. Just because some judge that cannot read the laws decides the Constitution is invalid in his own opinion, does not mean we have to knuckle under. They should not have to allow the homosexuals into their midst to become married. Even though the government passes a law that says it is ok, does not make it ok to join together two people of the same sex. That is NOT Holy matrimony. Do they not understand what a Sodomite is and why?

I'm fed up with the courts deciding that if one person wants something then they have the right to have it. Social morays are those that society want to live by, that is what LAWS are derived from. Though shalt not steal, is the theft laws where the hell do you think it comes from? That's why to teach the laws to kids in school is not a separation of church and state. It is the LAW, no religion, but we have gone astray! This is why I don't care what you do in your own bedroom, just don't make it public, you'll be fine. God did not demand any government to be Christian, nor any individual, he created us with the freedom to choose whether to believe and follow him or not, so one could make the case that our nation should be a Godly nation, because we modeled our nation to ensure freedom, just as God modeled mankind.     I wonder if Judge Solomon Metzger would rule that a synagogue was compelled to host a barbeque featuring pulled pork and baby back ribs or lose its tax-exempt status. Pretty much the same principles are at stake; pork lovers have a compelling interest in enjoying a nice lunch, and the fact that a Jewish congregation would "be loath" to allow it on their property is pretty much the same as the Methodists at Oceah Grove being loath to celebrate a same-sex marriage. I think that the complainants - the lesbian couple and the New Jersey Division of Civil Rights - are guilty of profound religious intolerance. This judgment cries out for review by the Supreme Court under the First Amendment.
