First Amendment Dumped. Sign a Petition – Get Arrested

The mayor of El Paso, Texas, is so upset with people who signed a petition that he wants them arrested. How dare these people express their constitutional rights in the United States of America where they are protected by the First Amendment to the Constitution.

The Scottsdale, Arizona-based Alliance Defense Fund, warned that hundreds of Christians and other El Paso citizens “are facing jail time for exercising their constitutionally protected right to speak out against Mayor John Cook’s policies.” The following is from Bob Unruh writing for WND:

The issue arose when voters in November 2010 placed on the ballot and passed an ordinance prohibiting unmarried domestic partner benefits in their city. Several members of the city council refused to follow the will of the vote, and voted to rescind the ordinance approved by voters. The mayor joined in the effort.

A number of citizens were outraged, so they started a grassroots campaign seeking to remove the mayor and city Reps. Susie Byrd and Steve Ortega who disregarded the will of the people. They did it by securing names for a recall petition. You can read about the recall effort in an article in the El Paso Times.

The vindictive Mayor John Cook “sued Tom Brown Ministries, Word of Life Church of El Paso, El Pasoans for Traditional Family Values and other local citizens who circulated recall petitions. He cited a Texas election law, arguing that it prohibits churches from circulating a petition.”

If there’s such a law on the books in Texas, it is blatantly unconstitutional. Consider the following from the Texas Constitution:

Art 1, sec 3a: EQUALITY UNDER THE LAW.  Equality under the law shall not be denied or abridged because of sex, race, color, creed, or national origin.  This amendment is self-operative.

If churches are prohibited from circulating a petition, then it is a violation of the above EQUALITY UNDER THE LAW provision since it refers to “creed” which is a reference to religion.

Section 6 deals with states in part: “No human authority ought, in any case whatever, to control or interfere with the rights of conscience in matters of religion. . .”

Consider what is stated in Section 8:

FREEDOM OF SPEECH AND PRESS; LIBEL.  Every person shall be at liberty to speak, write or publish his opinions on any subject, being responsible for the abuse of that privilege; and no law shall ever be passed curtailing the liberty of speech or of the press.

Consider what is stated in Section 27. Note the word “petition”:

RIGHT OF ASSEMBLY; PETITION FOR REDRESS OF GRIEVANCES. The citizens shall have the right, in a peaceable manner, to assemble together for their common good; and apply to those invested with the powers of government for redress of grievances or other purposes, by petition, address or remonstrance.

Notice that there are no restrictions on churches or religious organizations.

The following was added on November 8, 2005 in Section 32:

MARRIAGE. (a) Marriage in this state shall consist only of the union of one man and one woman.

(b)  This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.

When people who signed the petition spoke up at a public hearing, Mayor Cook said the following:

“Thank you, your time is over. If you can’t remove yourself from the podium, I’ll have you removed. Yeah. You can take your freedom of speech outside.”

So much for freedom of speech in El Paso, Texas.

    I lived in El Paso back in the late eighties, nice city then. Seems like it's been taken over by Mayor Stalin today. When is the will of the people and the Constitution deemed illegal? Back when the Founders of this great nation sought redress to their grievances, they had to send a letter or even travel to England. Generally, they were treated with utter disdain and sent on their way. Sound familiar? The American people are a peaceful and patient lot but they will be heard and they will not bend to the will of tyrants. I do not pray often enough but, when I do, I pray that politicos such as those in this article are cast aside for patriots before Americans reach the point of no return. I pray that the second American Revolution is fought at the ballot box, rather than at places like Valley Forge and Bunker Hill. The arrogance displayed by those who were elected to serve has worn down the tolerance of a fine people, the American people.     Obviously this Mayor is an AZ* H*LE, but he IS CORRECT about one thing.  Churches, in order to maintain their "tax exempt" status, CANNOT enter into anything political.  Their is absolutely nothing wrong with members of a particular church (or creed)  to circulate petitions for a political position, but THE CHURCH itself cannot be the driving force to circulate those same petitions.  It must be individuals, who just might happen to attend the same church, but not the church itself.  But, for instance churches can defend the tenets of their faith, such as the attack by Obama, trying to force churches, who have beliefs contrary to Obama's, and the government forcing those churches, and their organizations, (hospitals, schools, etc) to pay for contraception and abortion services contrary to their faith.  The most outrageous part of the "Obama lie" about this contraception mandate, is the democrats are "covering" this attack on religion, with a smoke screen, calling it an attack on "womens health".  That is a big load of "El Toro Poo poo".  Typical for the "liar in chief" in the White House!

    I think the Christian people who signed this petition and now face the threat of arrest should band together and if a police officer attempts to arrest them the Christians should actually arrest the police officer and charge him/her wih attempted false arrest and attempted false imprisonment. The only way to take a stand against this type of of Totalitarian Treatment by the system, is to arrest the arrestors, meaning the police.

    If ther police feared being arrested themselves, they would not attempt to make any arrests. The people need to band together, back each other up , protect one another, and if necessary reject the idea or notion that the police have the authority over your freedom especially in this case of freedom of assembly and freedom of speech.
     The police always call for back-up if they believe there is  probem too big for 1 or 2 officers to handle, so should the protestors, they should call for back up as well and back up each other and not allow any arrests to take place, as these arrests would be and are unlawful arrests because the Christians are exercising their Rights.

    The head of the BBC, Mark Thompson, has admitted that the broadcaster would never mock Mohammed like it mocks Jesus.
    He justified the astonishing admission of religious bias by
    suggesting that mocking Mohammed might have the “emotional force” of
    “grotesque child pornography”.
    But Jesus is fair game because, he said, Christianity has broad shoulders and fewer ties to ethnicity.

    had been Mohammed.
    He made the remarks in an interview for a research project at the University of Oxford.
    Mr Thompson said: “The point is that for a Muslim, a depiction,
    particularly a comic or demeaning depiction, of the Prophet Mohammed
    might have the emotional force of a piece of grotesque child
    A BBC spokesman was unavailable for comment.
    Last year former BBC news anchor Peter Sissons said Christians are
    “fair game” for insults at the corporation, whilst Muslims must not be
    Mr Sissons, whose memoirs were serialised in the Daily Mail, said:
    “Islam must not be offended at any price, although Christians are fair
    game because they do nothing about it if they are offended.”
    The former presenter also said that staff damage their careers if they don’t follow the BBC’s mindset.
