The Right and Duty to Change the Government

The First Amendment to the Constitution states as clearly as it can that the people have the right to “petition the government for a redress of grievances.” Wrapped up in this Constitutional right are additional rights regarding speech, press, and assembly. It’s a package deal. We can petition in several ways without hindrance: signs (press), speaking (speech), marches (assembly). Any attempt to “infringe” on these rights, including religion, is blatantly unconstitutional and un-American.

As a side note, for Christians who claim they must remain silent when government acts, keep in mind that the Constitution — our “Caesar” (Matt. 22:21) — gives us the right and duty to question its decisions and authority. The President of the United States took an oath before God to “preserve, protect and defend the Constitution of the United States.” At the start of each new Congressional year, those newly elected or re-elected Congressmen — the entire House of Representatives and one-third of the Senate — must recite an oath:

I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.

There is no violation of Romans 13:1–7 to petition any elected official because what is “due them” (v. 7) is found in the Constitution, a Constitution they took an oath to “support and defend.” The Constitution was designed by “We the People.” The Constitution is not designed for their protection but for ours. The powers of the President, Congress, and the Courts are limited according to the Tenth Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

In Book 1, Chapter 1 of Blackstone’s Commentaries the point is made that “every individual” has “the right of petitioning the king, or either house of parliament, for the redress of grievance.” Eleven years later, the Declaration of Independence listed King George’s failure to respond to the grievances listed in colonial petitions, such as the Olive Branch Petition of 1775, as a legal justification to declare independence:

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.

As far back as Magna Carta (1215) and the later Bill of Rights 1689, which explicitly declared the "right of the subjects to petition the king,” the people had a fundamental right to make their grievances known to those holding civil office.

Protests, tea parties, putting politicians and their policies on electoral notice, and packing Town Hall meetings to ask questions and voice grievances about legislative policies are fundamental freedoms that go back nearly 800 years. The Constitution codifies these freedoms. Of course, if our elected officials don’t read the bills they vote on, what makes us think they’ve read the Constitution? And even if they have read the Constitution, what makes us think they care what it says?

The Constitution is a prop to keep the people in check — until they read it. I’m surprised that almost nothing has been said about the First Amendment in this debate over the Tea Party movement. It’s time that we read the Constitution and throw it back in their faces, metaphorically speaking, of course.

    Well this is proof positive that the Constitution has been rendered irrelevant..I have always said that I don't think we can undo any of the things that are wrong , and taking place right now, that are in direct opposition to the Constitution..I hope I'm wrong..but there have been groups of people put in place to make it a fight all the way..If we don't set things right, our country will be gone...

      EXACTLY.  The statement "so help me God" doesn't apply to the muslim.  I still can't believe the people were stupid enough for vote for Obama.  But then again, many votes for him were fraudulent.

      Although that may be so, you would think (mistakingly) that the president would have more respect then, for his oath before Allah.  But he does not.  And when the congress or constitution gets in his way of doing what he wants to do any way in subversion of it and the people, he signs executive orders and approves appointees when congress is out of session as demonstrated proof of his continued violation of his oath of office!

    READ the Constitution.  READ the Declaration.  The Declaration clearly states, in regard to government run amok that "whenever any form of government becomes destructive of these ends, it is the right of the people to alter or abolish it and to institute new government."

       I'm with you 100%, It's time we did.  But, I can assure you, that due to our apathy for so long, that we have allowed them to intrench them selves and build vast safeguards to the People rising up against the Government.  At no time thru out history has there been a over throw of a siting government with out violence and casualties.  Our first revolution, was basically, musket to musket.   Today, maybe if we are lucky, it will be AR-15 vs Black Hawk.  And don't think for one instant they would hesitate to use it to keep their carcasses in the seat of power.   I have pondered this very situation at some length.  During our last revolution, we also faced not only the enemy, but our neighbors, and even our own kin. Same as the Civil War.  And the same will hold true now.  I personally face a conflict, I am a Vet, and have my beliefs of Duty and Honor, and I have a Son serving and they have made sure he has their beliefs.  The conflict is the possibility of facing my own Son on the battlefield for America's freedom.

Perhaps it's time you reminded him of his sworn duty as an American fighting man, rather than co-sign by silence the potential for obedience to unlawful orders from his superiors in rank.

         I believe most of the military and most of the police will be on our side. I talk with Military people all the time especially at the gun range, they are with us. Also we have over 100 million known legal gun owners in this country. Many of which are ex or retired military and police, the rest have been hunting and or shooting since they were 12. None of our high tech equipment has helped much in Aphganistan. We can take down the helocopters and the drones if we have to. We have the largest armed standing army in the world. The American God fearing Patriots have never lost a war!!!!!!!!!!!!!!

    "So help me God."  While true beleivers understand the eternal consequences of that statement, many, and I believe MOST, politicians are NOT true believers.  Therefore, most politicians feel there are NO consequences to breaking their Oath of Office, aside from losing re-election due to an outraged electorate which only comes from an enlightened electorate - more often than not, an oxymoron.
    I would like to see criminal penalties associated with breach of Oath of Office beginning with removal from office plus a lifetime ban on holding any public office.  This could be adjudicated by a state attorney general from any state other than the representative's own state.  This should remove most political influences from within the dirty critter's own state and aside from national political party influence, should be as impartial as humanly possible.

Discredit the American Constitution by calling it inadequate, old fashioned, out of step with modern needs, a hinderance to cooperations between nations on a world-wide basis. Need I go on?     Our Constitution and Declaration of Independence were written by men that were divinely inspired , but the documents are nothing more than paper and ink until WE THE PEOPLE trully accept them into the very fabric of our being and are willing to accept them, even to the death. Anything less than taking a stand for our morals and priciples is cowardice and will paid in kind by the tyranical despots by either slavery or incarceration, for they see our sacred documents as mere pieces of paper and not documents with words that have come from our most awsome omnipotent CREATOR OF ALL THE SEEN AND UNSEEN, these tyrants (wannabees) don't know who they are messing with.
    Stand up with guts and determination to these less than worms that crawl beneath our feet and show them the respect that they really disserve!
    They work for us (we pay their saleries), so unless they do actually represent our wellfare, we must get the master at arms to remove them and try them for treason to the United States of America.

    I would like for the citizens of the world to know that it is the people and not the government that are the true representation of America and it is not the majority of the citizens of America that want to envade the soereignty of foreign countries to kill their men women and children and destroy their homes just for the plunder that the powers that dictate to our government can enjoy, and we tell them that it for their protection, give me a break, and our government tells us that they are potecting us , what are they telling us by initiating the NDAA and militerized police and drones .... they must think that the people in the United States of America are just plain stupid to buy their BS crap.
    Please know what evil lurks in the hearts of those that might want me to dissapear.

    This is why the progressives want to separate the Constitution from the Declaration of Independence. They want what they call a "Living Constitution" that they can change to fit their daily habits. Progressivism was brought here from Europe in the late 1800's. The intelligentsia fell in love with it, and the country has been heading down hill ever since. Remember on thing, a person that does not honor his/hers oath is not a honorable person. "We the People" have been remiss in our duties, because it is us that elect and re-elect these dishonorable people to represent us.

      Excellent point in that the fault ultimately belongs to the citizens for failure to do their due diligence when it comes to casting their vote.  Have you ever seen the videos of professed Obama supporters being asked whether they support Obama's pro-life position?  They immediately agree with Obama.  When asked about Obama's position on limited government, they also agree.  In response to every question they agree with Obama's so called position, even though in every instance, the stated position is completely opposite of Obama's real position.  It's amazing how people get through life without any idea what goes on around them, much less cast a knowledgable vote to decide the future of this great nation.

      Representative Adam Clayton Powell (D-NY) spent his time as a congressman in the Bahamas.  When asked, he bluntly stated that "The first duty of an elected official is to get himself re-elected."

      Now, I have no love or respect for the man, but I am in awe when a member of congress tells the truth while sitting on the beach sipping a drink -- in effect, thumbing his nose at the concept of representing his constituents except enough to get another two year free ride.

        I am now 70 years of age and believe me, I know politics, not from any emotional level but realistically.
        May I suggest for your edification the story of Adam Clayton Powell Jr. "The last of the Cats" better understand what he did, beyond those disgraceful and wasted last years.
        I was being facetious and perhaps , the words "SHOULD BE' may have been better suited in getting my point across.
        I opine that the last honest and non self centered politician in my lifetime, whether or not one agrees with his policies was HARRY S. TRUMAN .

    the republic was incorporated and it's buisiness distric was established  in Colombia a city state  situated between maryland and Virginia ....  They defined a  Constitutional change that changed the relationship between the prolitariat and the presiding officials ....putting into place a two party dictatorship .*( The first president to issue an executive order was Abraham Linholn and still used today )... and the use of the electorial college   ...favoring  big land owners and big buisinesses..... Only under a dictatorship can you be threatened by Marchal law ...

      WOW!    LK needs to re-read history and the documents it has spawned -- this time for comprehension.  "Prolitariat" is a word first popularized used in Marx's writings, the Communist  Manifesto and later communist propaganda.  It is NOT a part of 19th century American legislation.

      And, LK, the word is "martial" law -- as in military -- not "Marchal" a word that does not even appear in the dictionary (both Webser and Oxford) and is too far removed from the true spelling to be a mere typo. 

      I make typos all the time, but at least I feel upset about it.  If you're going to use a word depicting a concept such as suspension of civil liberties ... at the very least you should know how to spell it.

    Yet, when citizens question the authenticity of Obama's citizenship, and position as a natural born citizen, and therfor qualified for office- the complaint is thrown out of court as not having "standing". How does this fare in the face of the first ammendment? Should we not be allowed to question the authority of the very person who leads our country? I'm not sure if they are right or wrong, I just believe they should be allowed their day in court to see evidence of thi smost fundamental question. If you ask for my birth ertificate, I can show you the one that has my footprints on it. Whay cannot our president do the same? Why must he rely on a document that is obviously forged even to the most casual of observers?

    The courts, the executive and legislative branches need their wings clipped.  They must be limited to the powers granted in the constitution and nothing else.  It may take a revolt to get their attention but free men will not accept the yoke of bondage.

    Dear friends and politicians,
    As a nation of voting citizens ("one nation, under god") I'm sure we are all praying diligently for our country's future. I do thank the Democratic Party for returning God to this political platform. Whether a political tweek or a devine reference, I can still believe that we have the right to freedom of religion. Friends, please never take such a freedom for granted! Unfortunately, I am still not sure if this president does pray to the same God!
    Regarding this issue, talk-show host, Michael Savage commented, “America is disgusted with this party of atheists and America haters.”>
    Could someone please clarify if our president, while never joining a socialist party such as the New Party during his efforts in congress, did allow such a socialist party to coax any of his political decisions with their endorsement? Mr. President, please be honest with us. After all, equality is a very important concept within our nation and I do believe you would share your honest decisions with everyone-equally!>
    Some of the history books which I have read describe the rise and fall of many kingdoms, which were time and time again focused on the power of their political leaders which never truly represented the people. Such historical reminders should truly frighten everyone, especially when we see any country being controlled or moving toward such control by greedy leaders. On a more personal note, I am concerned about the overall integrity of our healthcare industry. I must say that I have been very fortunate to have the same doctor (very sincere and empathic) working with my medical issues during the past two decades. Recently, my doctor discussed his decision to move from the well-established medical group to a government run hospital. He described the decision as practical since more government policies at all levels make it more difficult to actually "help the patient." Upon my departure he sadly commented, “oh well, if you can’t beat them, join them.” I am concerned about the difficulty in finding another sincere doctor since so many seem to be leaving do to such constraints.Also, with the new Obamacare plan that has been financed with my medicare money, will I be able to capture any of the dollars which I paid in? I would like to come up with the funds for a death/burial plan and was wondering if I could possibly borrow against the medicare funds (not even a trillion dollars!) for such insurance policy?I believe there is truly hope for our nation as we realize our rights and obligations during this election season. However, as we watch the upcoming presidential debates and campaign dogma, lets not forget that we need (along with a real president) a sincere congress that will support the people!Maybe it is time for a "tea party"!Thanks for allowing me to share.Another Concerned Citizen
