Democrats Now Pushing Mandatory Liability Insurance for Gun Owners

Vice President Joe Biden spoke the truest words of his political career last week when he said this is only the beginning of the process, concerning gun control.

Rep Carolyn Maloney (D-NY) has introduced another people control anti-gun piece of legislation that would require anyone wanting to buy a gun to also purchase gun liability insurance.  Under the Firearms Risk Protection Act, anyone purchasing a firearm after the effective date of the bill, who fails to purchase the proper liability insurance would be subject to a fine of up to $10,000.

The bill specifies that the insurance must be purchased from a company that has been licensed or authorized by the state insurance authorities.  The insurance must be written such that it would cover the owner of the firearm for any losses or injuries resulting from the use of that firearm as long as it is owned by the person who purchased it.  Members of the military, law enforcement and government employees would be exempt from having to purchase the liability insurance.

Maloney commented on the proposed bill, saying:

“For too long, gun victims and society at large have borne the brunt of the costs of gun violence.  My bill would change that by shifting some of that cost back onto those who own the weapons.”

“We have a long history of requiring insurance for high-risk products — and no one disputes that guns are dangerous.”

“While many individual states are debating this issue now, it makes more sense for Congress to establish a national requirement to allow the insurance markets to begin to price the risks involved consistently nationwide.”

Co-sponsors of the bill include: Rep Earl Blumenauer (D-OR), Rep Michael Capuano (D-MA), Rep Keith Ellison (D-MN), Rep Stephen Lynch (D-MA), Rep Jim Moran (D-VA), Delegate Eleanor Holmes Norton (D-DC), Rep Bobby Rush (D-IL) and Rep Niki Tsongas (D-MA).  Democrats every one of them.

So what happens if someone breaks into your house and they have a weapon and threaten you or a member of your family and you shoot them in self-defense?  Are you still going to be held liable and your insurance ends paying for the criminals medical or funeral expenses since you are the owner of the gun?

When Maloney equates requiring gun liability insurance to that of other high risk products, she forgets one vital factor.  The Second Amendment gives Americans the right to own and bear firearms without any infringement by the government.  Other high risk products don’t have that same constitutional right.

Chris Cox, Executive Director of the NRA’s Institute for Legislative Action commented on the proposed bill in an interview with The Daily Caller.  Cox described the bill as:

“Ridiculous on its face, as it presumes law-abiding gun owners are guilty for merely exercising a fundamental, constitutional right.”

“But it does reveal what Rep. McCarthy [Maloney] really thinks about honest people who believe in the right to keep and bear arms.”

If for some reason this bill manages to get passed, I hope that it is challenged in court based on it being unconstitutional.  How can someone be required to purchase insurance for exercising a constitutional right?  I know that the US Supreme Court upheld the insurance mandate provision in Obamacare, but health insurance is not a constitutional right like gun ownership is.  Besides, the only reason Chief Justice Roberts voted for the insurance mandate was because the penalty is not a penalty but a tax to collected by the IRS.

As many of us have said all along, it’s not about guns, it’s about people and controlling people.  The Democrats have become so socialistic in their thinking that they believe that the government should control every aspect of our lives and that we should abandon all religion and hope and just live to serve the government.  They forget that the Founding Fathers set up the government to serve the people, not the other way around.
