Obama Negotiated with Big Business but Not GOP Over Obamacare

The whole government shutdown has been due to one thing only – President Obama says he will not negotiate with the Republicans over Obamacare.  He says Obamacare is the law and it will remain as it is without any changes or alterations.

Due to the pressure and complaints from so many big businesses, Obama decided on his own to delay the implementation of Obamacare for one year.  He basically negotiated with big business to try to appease them.  Yet, he refuses to negotiate with Republicans.

In fact, a lawsuit has been filed against Obama for making illegal changes to Obama.  Judicial Watch filed the lawsuit in the US District Court for the Southern District of Florida on behalf of Kawa Orthodontics LLP.  They contend that when Obama announced the one year delay in the implementation of the employer mandate it:

“Exceeded [the Obama administration’s] statutory authority, is arbitrary, capricious, and contrary to law, and is otherwise unlawful.”

The lawsuit further states that Obama’s arbitrary decision cost Kawa Orthodontics:

“To lose the value of its substantial efforts to prepare for the controversial provision taking effect beginning next year.”

“[Kawa Orthodontics] expended substantial time and resources, including money spent on legal fees and other costs, in preparation for the ‘employer mandate’ taking effect on January 1, 2014….[The company] would not have expended its time and resources and incurred these anticipatory costs in 2013 if the mandate had not been scheduled to take effect until 2015, but instead would have spent its time, resources, and money on other priorities.”

They claim that Obama’s sudden and arbitrary decision to extend the implementation date for the employer mandate violated the Administrative Procedure Act.  Since Obamacare is a law that was passed by Congress, legally, any modification to the law must be done through congressional action and not by a declaration of the president.  In their lawsuit, they are asking that the delay in the implementation of the employer mandate be declared unlawful and that an injunction prohibiting the delay be rendered.

Even though Judicial Watch objects to Obamacare, the employer mandate, insurance mandate and contraception mandate, they feel that Obama’s actions in delaying the employer mandate was done illegally.  Tom Fitton, President of Judicial Watch explained:

“We obviously object to the employer mandate and the entire Obamacare law, but we understand that, under the U.S. Constitution, the law can only be changed by legislation passed by Congress and signed by the president. President Obama would delay the damage of his health care scheme until after the 2014 congressional elections. But politics do not trump the Constitution or the rule of law.  And to paraphrase Ulysses S. Grant, the best way to ensure the repeal of a bad law is to enforce it vigorously.”

Dr. Larry Kawa, Founder of Kawa Orthodontics LLP in Boca Raton, Florida commented about the lawsuit, stating:

“I am tired of Washington, D.C., picking winners and losers and giving preferential treatment to those inside the Beltway. This is just more of D.C. career politicians protecting their own.”

Obama’s hypocrisy needs to be broadcast across the nation from every media source there is.  The House GOP needs to be asking him why he negotiated with big business but refuses to negotiate with them, forcing the government shutdown.  Furthermore, Obama has repeatedly criticized big business interests and claims that he fights for the concerns of the American people, yet he gave big businesses a year extension that he refused to give to the American people.  Obama is a liar, hypocrite and the most dangerous man ever to hold the office of President.  He has repeatedly overstepped his legal powers as president and acted more like a tyrant dictator that doesn’t care about the people, the law or the Constitution.
