Black Firefighter Candidate Sues to Get Job After Failing Physical THREE Times

A black wannabe firefighter in New York City is now suing the city to be awarded the job even though he failed the physical test THREE times.

Naturally, everything is raaaacist.

African American job-seeker Kevin Walker, 47, has filed suit against the city crying discrimination despite being unable to meet the city’s physical requirements for the job.

As the New York Post writes:

Kevin Walker, 47, had been a lead plaintiff in the Vulcan Society’s class-action case against the city, which accused the department of discriminating against minority firefighter applicants and was settled in 2014 for $100 million. The Jamaica, Queens, resident got $22,500 of that payout.

The New York Fire Department says that the lawsuit made Walker a “priority hire” once he passed the written test in 2013. Indeed, the FDNY was going to allow him to take a job even though he is also past the 35 minimum age limit.

But despite all the breaks, despite the $22 grand, despite all that, over the next few years he failed the physical test THREE times.

Now what is he doing? Yep, suing again.

According to the Post:

“It’s my understanding that he petitioned the court to just put him in. That’s absurd if you’ve already proven . . . that you can’t get it done,” an FDNY source said.

Waker claimed that the officers administering the test acted against him (naturally).

But the FDNY disagrees:

Responding in court documents, the city said Walker failed fair and square and noted that he had provided no evidence to prove his time was recorded inaccurately or that the proctors knew of his involvement in the lawsuit.

“Petitioner provides no basis, other than his alleged ‘thought’ or ‘belief,’ to support his assertion that the proctor even knew that petitioner was a lead plaintiff in the Vulcan lawsuit,” the city wrote in a 2016 motion to dismiss.

The city says the whole thing is “absurd” and that Walker just can’t cut it as a fireman. And he has spent five years proving it!
