ExxonMobil has beaten the climate change religionists by winning the first-of-its-kind climate change fraud lawsuit filed against it in a New York court this Tuesday.
The state of New York took the energy giant to court claiming that the company misled its investors about the risks of global warming and the role fossil fuels supposedly have in endangering the earth.
But the global warming-pushing state lost its case when New York Supreme Court Justice Barry Ostrager said New York’s Attorney General “failed to prove that Exxon violated the Martin Act, a broad state law that does not require proof of intent of shareholder fraud,” the Washington Examiner reported.
“The office of the Attorney General failed to prove, by a preponderance of the evidence, that ExxonMobil made any material misstatements or omissions about its practices and procedures that misled any reasonable investor,” Justice Ostrager wrote in his 55-page ruling.
The oil company celebrated the ruling:
“Today’s ruling affirms the position ExxonMobil has held throughout the New York Attorney General’s baseless investigation. We provided our investors with accurate information on the risks of climate change,” Exxon said in a statement. “The court agreed that the Attorney General failed to make a case, even with the extremely low threshold of the Martin Act in its favor.”
Naturally, the extremist, left-wing New York politicians using their official positions to push a wild-eyed, partisan agenda are defiant.
“Despite this decision, we will continue to fight to ensure companies are held responsible for actions that undermine and jeopardize the financial health and safety of Americans across our country, and we will continue to fight to end climate change,” said New York Attorney General Letitia James.
The left will not stop employing lawfare to push its un-American, anti-science agenda, granted. But this particular battle is over. And the good guys won.
