A former McDonald’s worker in California is now set to go on trial for felony assault after being accused of poisoning a police officer’s food.
Tatyana Hargrove, 21, was arrested last year on a felony charge of willfully poisoning food. The one-time Bakersfield fast food employee is also accused of shouting, “Black Lives Matter,” and, “Fuck the pigs!” at the officer, according to the Washington Examiner.
Deputy public defender Lexi Blythe argued before court that there was not enough evidence for a felony charge because Blythe’s back was to the camera in the kitchen area where she allegedly spat on the officer’s camera. Blythe also said that there is not enough evidence to know if the burger was sprinkled with harmful chemicals like those used for cleaning.
On the other hand, Prosecutor Gina Pearl insisted that spittle could be considered dangerous. “Look at what’s going on in the world right now with the coronavirus,” she said.
The officer was not immediately aware that his food had been tampered with. And he later tested negative for HIV and hepatitis.
The judge did dismiss a charge of misdemeanor battery after finding a lack of evidence for the charge.
Hargrove has a history of claiming police brutality.
In 2018, she claimed to be a victim of police brutality after being arrested by police in 2017.
Hargrove claimed that cops drew guns on her without cause and treated her violently.
She sued the city of Bakersfield but lost her case.
