KY Clerk Kim Davis Jailed for Breaking NO Law

Kim Davis is the County Clerk for Rowan County which encompasses Ashland, Kentucky. She’s made national headline news by refusing to issue marriage licenses to homosexual couples. When protests started, she refused to issue marriage licenses to everyone.

Of course the liberal media, who is always hungry to devour Christians and conservatives, flocked to Ashland and packed the County Clerk’s office. One reporter asked her on what authority was she refusing to issue the marriage licenses and she boldly replied ‘on God’s authority.’ You know that was totally unacceptable to our heathenistic media and society who no longer care about or respect a person’s First Amendment right to freedom of religion.

Incidentally, one of the couples causing the legal stink over Davis’s insistence that she has to violate her First Amendment rights is a gay couple from Ohio. They can easily obtain their marriage license in their own Ohio county, but decided to travel to Ashland just to participate in forcing a Christian to go against her faith. Then they went on camera to charge Davis with trying to force her beliefs on them when in fact that’s exactly what they are doing to her.

On Thursday, Davis again refused to put her name on a marriage license for a sinful union, so a judge threw her in jail. The judge and everyone else is pointing to the Supreme Court decision earlier this summer as the reason Davis should comply with the law. But what law would she be complying with?

Mike Huckabee, former Governor of Arkansas and current GOP presidential candidate brought up a legal point that no one seems to be aware of. After contacting Davis and offering her encouragement for her stand, Huckabee sent the following out to his supporters:

I spoke with Kim Davis this morning to offer my prayers and support. For those of you who don’t know, Kim is the Rowan County Clerk, a Democrat, who is under fire from the left for refusing to issue same-sex marriage licenses in Kentucky.

I let Kim know how proud I am of her for not abandoning her religious convictions and standing strong for religious liberty. She is showing more courage and humility than just about any federal officeholder in Washington.

Kim is asking the perfect question: ‘Under what law am I authorized to issue homosexual couples a marriage license?’ That simple question is giving many in Congress a civics lesson that they never got in grade school.

The Supreme Court cannot and did not make a law. They only made a ruling on a law. Congress makes the laws. Because Congress has made no law allowing for same-sex marriage, Kim does not have the Constitutional authority to issue a marriage license to homosexual couples.

Kim is a person of great conviction. When people of conviction fight for what’s right they often pay a price, but if they don’t and we surrender, we will pay a far greater price for bowing to the false God of judicial supremacy. Government is not God. No man – and certainly no unelected lawyer – has the right to redefine the laws of nature or of nature’s God. Five unelected lawyers have abused their power by ruling in favor of a national right to same-sex marriage with no legal precedent and with nothing in our Constitution to back it up. They have violated American’s most fundamental right guaranteed by our Constitution — religious liberty.

I stand with Kim Davis and every American of faith under attack by Washington elites who have nothing but disdain for us, our faith and the Constitution.

If you stand with us, please sign my petition in support of religious liberty here.

With gratitude,
Mike Huckabee

Huckabee correctly points out that according to the US Constitution, the Supreme Court cannot make law. In their infamous betrayal of America’s Christian and family values, they only issued a ruling on a law, and that law banned same-sex marriage. They did not automatically create law to allow same-sex marriages. Only Congress or state legislatures have that right.

I live in Kentucky and to the best of my knowledge the Kentucky state legislature has not passed any law legalizing same-sex marriage. Therefore, Kim Davis has not violated any law and should not be sitting in an Ashland jail cell. Not only has Davis not violated any law, she was legally acting in accordance with her First Amendment right to the free exercise of her religion.

Kim Davis was jailed because of her Christian faith. Our liberal and sinful culture cannot and will not tolerate Christians standing firm on their faith. The cry that all they want is for Christians to be tolerant of them and accept them but a true Christian cannot be tolerant or accept homosexuality. God spoke out very strongly against homosexuality and even the New Testament states that a homosexual cannot inherit the kingdom of God.

Like Huckabee, I fully support Kim Davis and pray that she remains strong for her Christian faith. I know that I’m willing to go to jail, lose everything including my life for the sake of Christ. Are you willing to sacrifice everything for Christ? Think long and hard because many people will say they are but at the first sign of trouble and faced with losing what they have, will cave in to save their lives and possessions. Jesus didn’t have to die for us but He did. I don’t have to die for Jesus but I will. Will you?
