Last October, Pennsylvania Judge Mark Martin used sharia law to acquit a Muslim of charges of assault. Talaag Elbayomy was watching a Halloween parade pass by when he spied Ernie Pierce, an atheist, dressed as a zombie Muhammad. Elbayomy, being the good Muslim he is, physically attacked Pierce, knocking him to the ground and kicking him.
A local police officer witnesses the assault and arrested Elbayomy. The attack was also caught on video and presented as evidence in the trial. However, Judge Martin, not only acquitted Elbayomy of the assault charge, he lectured Pierce about his insensitivity toward Islam. He blamed Pierce for the whole incident saying:
“They are so immersed in it and what you’ve done is you’ve completely trashed their essence, their being. They find it very, very, very offensive. I’m a Muslim. I find it offensive.”
Martin just happened to be a convert to Islam and he superseded Pennsylvania and U.S. law by using sharia law as the basis of this ruling.
The Legal Project, part of the Middle East Forum took up Pierce’s case and filed a complaint with the Pennsylvania Judicial Conduct Board concerning Martin’s use of sharia law and obvious disregard of American law. The PA conduct board claims that they have privately rebuked Martin for his conduct, but The Legal Project believes they should have done more including removing Martin from the bench. San Nunberg of TLP said:
“This ruling throws out our United States Constitution, throws out our First Amendment, puts Islamic anti-blasphemy defamation of religion laws over our First Amendment, gives it binding in the court system, and lets the defendant off of a crime, rationalizing that what he did would not be wrong in Islamic countries.”
“The Judicial Conduct Board should revisit their decision and should lead an enquiry, which should possibly lead to dismissal. His term extends into 2018. A private rebuke is certainly not something that was fitting of conduct in the courtroom from the bench.”
Since this isn’t the first case where a U.S. judge has ruled using sharia law instead of American law, a clear example must be made in this case. Judge Mark Martin needs to be removed from the bench and banned from ever holding a judicial position in the U.S. Hopefully, other Muslim judges will see this as warning to rule on state and U.S. law and not sharia law or they stand to lose their position on the bench for life.
