Sheriff Joe Arpaio Files Lawsuit to Stop Obama’s Executive Amnesty Order

Thursday night, Barack Obama finally lived up to one of his promises, but it was a promise to protect illegals at the cost and safety of American citizens. He took this action so that he would hopefully win the loyalty and votes of millions of illegals for the 2016 elections. Democrats have been fighting to protect the ability to commit voter fraud and pave the way for the illegals to illegally vote in future elections.

Republican leadership has been posturing and threatening to do something, but they were not the first to take action to stop Obama. Maricopa County Sheriff Joe Arpaio has no love for Obama.

Arpaio’s department is the ONLY law enforcement agency in the United States to investigate Obama’s birth certificate and his eligibility to occupy the White House. Obama and his henchman puppet Attorney General Eric Holder went after Sheriff Joe with efforts to unseat him from office and to discredit and undermine his sheriff’s department. They brought charges of racial profiling against Arpaio for doing his job in going after illegal immigrants and drug traffickers of which over 90% are Hispanic. They stripped the sheriff’s department of their federal immigration enforcement status and persuaded a liberal judge to place a moderator over the department to monitor every arrest and action taken to make sure they are not racial profiling against Hispanics.

Sheriff Joe wasted no time after Obama’s immigration announcement. Less than two hours after Obama betrayed Americans, Arpaio filed a federal lawsuit against Barack Obama; Jeh Johnson, Secretary of Homeland Security; Leon Rodriquez, Chief of Immigration Services; and Eric Holder, Attorney General. The lawsuit was filed in the US District Court for the District of Columbia and asks for a permanent injunction against Obama’s amnesty program, declaring the program to be unlawful.

The lawsuit claims that Obama’s 2012 DACA action and his Nov. 20, 2014 executive order is an abuse of the president’s role ‘in our nation’s constitutional architecture’ and that it ‘exceeds the powers of the president within the US Constitution.’ It further states:

“While defendant Obama hijacks the language of previous immigration regulation and law, defendant Obama fundamentally transforms the definition of key terms to create a radically new and different regime of immigration law and regulation.”

“DACA and EOA are sweeping changes to immigration law and regulation, operate on a ‘wholesale’ level upon broad categories rather than ‘retail’ as an individualized adjudication of persons one at a time, operate in and modify areas already regulated differently by existing regulations, and are a dramatic departure from prior interpretation and application of existing law and regulations.”

“Yet the Obama administration purports to effect the dramatic changes by executive order announced by the president, implemented through his cabinet secretaries.”

“The president cannot simply announce sweeping new rules and implement them by giving a speech.”

Arpaio released a statement saying:

“This unconstitutional act by the president will have a serious detrimental impact on my carrying out the duties and responsibilities for which I am encharged as sheriff. Specifically, it will severely strain our resources, both in manpower and financially, necessary to protect the citizens I was elected to serve. For instance, among the many negative [e]ffects of this executive order, will be the increased release of criminal aliens back onto streets of Maricopa County, Arizona, and the rest of the nation.”

“I am not seeking to myself enforce the immigration laws as this is the province of the federal government. Rather, I am seeking to have the president and the other defendants obey the U.S. Constitution, which prevents this executive order from having been issued in the first place. This unconstitutional act must be enjoined by a court of law on behalf of not just myself, but all of the American people.”

Larry Klayman is the attorney that filed the lawsuit on Arpaio’s behalf. Klayman, Founder of Judicial Watch and Freedom Watch was a former federal prosecutor. One of his latest accomplishments was winning an injunction against the NSA for their unconstitutional spying on Americans’ telephone metadata. Klayman also filed several lawsuits in various states challenging Obama’s eligibility to run for president.

The district court in DC is hard to read. At times it seems to be quite liberal in its support of Obama and other times it has surprised many by ruling against him. Hopefully, the court will put politics aside and realize that Obama is not an emperor who can just make laws on his own without first going through Congress. The Founding Fathers purposely established a three sectioned federal government to prevent any one person from having the tyrannical power that Obama assumes he has.

Hopefully, the lawsuit will block Obama’s illegal actions from taking effect and successfully nullify his illegal DACA order that allowed nearly a million illegals to remain illegally in the United States. I’m praying that in 2016, Americans will then elect a president who has the good of the nation and the American people in mind and orders the execution of federal immigration laws to be carried out and that millions of illegals will be deported, sending a signal for others that if they want to come here that they need to go through legal channels like other do.
