US Attorney Frees Lerner from Contempt of Congress Prosecution

After the IRS targeting scandal erupted, it became apparent that Barack Obama and IRS officials had decided to make IRS supervisor Lois Lerner the scapegoat. Although evidence pointed all the way to the Oval Office, it seems that the brunt of blame was to rest squarely on Lerner’s shoulders.

However, the wolves in the White House continued to provide some protection of Lerner with the help of Obama’s legal puppet Eric Holder and some handpicked IRS officials. When Congress subpoenaed Lerner’s emails they were told that they had all been lost due to a computer crash. When asked for the backup files of her emails, IRS officials told Congress that they too had been destroyed, which we know now was a lie.

Lerner was placed on paid administrative leaving, still earning her high salary for months while she sat at home wondering her fate. When she was hauled before the House of Representatives for questioning, she maintained her innocence while refusing to answer many of the questions asked by House members. Consequently, the House Oversight and Government Reform Committee chaired by Rep. Darrell Issa (R-CA) voted to hold Lerner in contempt of Congress.

Following procedure, the contempt of Congress citation was then forward on the US Attorney’s Office for the District of Columbia. That office was given the responsibility to prosecute Lerner on the contempt charge.

After almost a year, outgoing US Attorney Ronald Machen has announced that they will not prosecute Lerner on the contempt of Congress charge. Although Machen resigned his posted as of April 1, he wrote a letter to House Speaker John Boehner, stating:

“The team also concluded that Ms. Lerner did not waive her Fifth Amendment privilege by making an opening statement on May 22, 2013, because she made only general claims of innocence. Thus, the Fifth Amendment to the Constitution would provide Ms. Lerner with an absolute defense should she be prosecuted under [Congress’ contempt laws] for her refusal to testify.”

“Given this assessment, we have further concluded that it is not appropriate for a United States Attorney to present a matter to the grand jury for action where, as here, the Constitution prevents the witness from being prosecuted.”

Boehner responded to the letter, saying through his spokesman Michael Steel:

“Once again, the Obama administration has tried to sweep IRS targeting of taxpayers for their political beliefs under the rug. But unaccountable federal bureaucrats using their power to attack the First Amendment strikes at the heart of our democracy, and the American people deserve the truth. The White House still has the opportunity to do the right thing and appoint a special counsel to examine the IRS’ actions.”

Rep. Jason Chaffetz (R-UT), Issa’s successor as Chairman of the House committee, also responded to Machen’s letter, stating:

“Today’s announcement is disappointing and exhibits a disregard for the rule of law. Mr. Machen attempted to absolve Ms. Lerner of her actions by substituting his judgment for that of the full House of Representatives. It is unclear whether the Administration directed Mr. Machen not to prosecute Lois Lerner, or whether he was motivated by an ideological kinship with IRS’s leadership.”

“The Committee will continue to pursue its ongoing investigation into the targeting of American citizens based on their political beliefs. Our goal is to ensure that the people responsible, including Lois Lerner, are held accountable, and that appropriate reforms and safeguards are put into place at the IRS to guarantee that the rights of Americans are not trampled on again by overzealous bureaucrats with political agendas.”

That’s all the Obama administration has done is trample on the rights of Americans with their political agendas. I once thought that Lyndon Baines Johnson was the most corrupt president that our nation ever had, but Barack Obama makes Johnson seem like a Boy Scout in comparison. Breaking the law and violating the Constitution runs rampant in the Obama administration, starting in the Oval Office on down to supervisors like Lois Lerner and like most crooks they strive to protect their own.
